DMCA Copyright Policy

1. Reporting Copyright Infringement

If you believe that content available on or through Flicker infringes one or more of your copyrights, please send a written notice (“DMCA Notice”) to our designated Copyright Agent with the following information:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
• Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of such works.
• Identification of the material claimed to be infringing and information reasonably sufficient to allow us to locate it (e.g., a link, video title, or in-app content ID).
• Your name, mailing address, telephone number, and email address.
• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

Notices sent to any other address or that do not comply with the requirements above may not receive a response.

2. Counter-Notification

If you believe that the content you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with us. Your counter-notification must include:

• Your physical or electronic signature.
• Identification of the material that was removed or disabled and its location before removal.
• A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the U.S., any judicial district in which Flicker may be found), and that you will accept service of process from the person who filed the original notice or their agent.

Upon receipt of a valid counter-notification, we may reinstate the removed content in 10–14 business days unless the original complainant files a court action seeking a restraining order.

3. Repeat Infringer Policy

Flicker will, in appropriate circumstances, disable or terminate the accounts of users who are determined to be repeat infringers in accordance with the DMCA.

4. Misrepresentations

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be liable for damages.
